Welcome to Extrafeet™, an online and mobile social application development and publishing company. “Extrafeet” refers to Extrafeet, Inc., and its Affiliates, which shall mean subsidiaries, parent companies, joint ventures and other corporate entities under common ownership. We may also refer to Extrafeet as “We” or “Us”.
We provide this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of any application, game and/or forum we may provide on various websites (the sites, applications, games and these forums collectively, the “Services”). This Privacy Policy applies only to information that you provide to us through the Services.
By accessing any of our Services, you agree to the terms of the most recent version of this Privacy Policy. By agreeing, you authorize us to collect and use your information as outlined below. In the event you do not agree with any modifications made to this Privacy Policy, your only recourse is to cease use of our Services and, where applicable, delete the application. Please see the section entitled “Managing Your Personal Information” to request the deletion of your profile.

We may collect or receive information from other sources including (i) other Extrafeet users who choose to upload their email contacts, and (ii) third party information providers. This information will be used to supplement your profile - primarily to help you and your friends connect. It will be combined with other information we collect.
The user information gathered as a result of using the Services is primarily used to provide you a better user experience when using the Services. By installing and allowing the Services you are granting Extrafeet permission to gather and use the user information available via www.facebook.com (“Facebook”) in accordance with Facebook’s own policies and terms. In general, we collect, store and use your information to provide you with a safe, smooth, efficient, and customized experience. For example, we may use information collected from you in any one or more of the following ways:
One important use of your information is communication. If you have provided your e-mail address to Extrafeet, we’ll use it to respond to (i) customer support inquiries, and (ii) keep you informed of your in-game activity, including comments from friends, notifications about in-game status such as notifications of gift and league requests. We may also send promotional e-mail messages (“Promotional Communications”) directly or in partnership with parties other than Extrafeet.
You always have the choice to stop receiving Promotional Communications. When you receive Promotional Communications from us you will have the opportunity to “opt out” by following the unsubscribe instructions provided in the Promotional Communication you receive. Please note that we may still send you administrative messages regarding Extrafeet games, including, for example, administrative confirmations, and notices of updates to our Policies. Extrafeet Registration. When you register through the Services and submit your Personal Information to join the Services, Extrafeet Users may see your game username and the other information about you. We may display your Personal Information on the Services according to the preferences you set in your Facebook account or Settings panel inside the game application. Any information you choose to provide should reflect how much you want other Extrafeet Users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage members to think carefully about what information about themselves they disclose. You can review and revise your Facebook profile or in-game Settings information at any time.
Aggregate Information and Non-Identifying Information. We may share aggregated information that includes your Personal Information, Non-Identifying Information and Log Data with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and services.
Service Providers. We may employ third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform tasks, (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Services) or to assist us in analyzing how our Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you. You can, at any time, opt out of receiving such communications.
Compliance with Laws and Law Enforcement. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Extrafeet or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity.
In the event that there is a change in the majority ownership of Extrafeet (e.g. sale, merger, acquisition, bankruptcy, etc.) we reserve the right to transfer your user information to the new owner or assignee in accordance with applicable law. In such an event, users will be notified of the transfer of user information to the best of Extrafeet’s abilities and users will be subject to any changes in privacy policy.
The Services are not directed to children under the age of 13 years and children under the age of 13 are prohibited from using the Services. We will never request personally identifiable information from anyone whom we know to be under the age of 13. By using the Services, you represent and warrant that you are at least 13 years old. In the event that we learn we have inadvertently gathered personal information from children under the age of 13, we will take reasonable measures to promptly erase such information from our records.
We recommend that all minors 13 years and older seek parental consent before sending information about themselves to any individual or over the Internet.
If you play any of our games/applications on or through Facebook, Extrafeet will be able to access and store profile and other information about you as described above. The categories of information you share with us will depend, in part, on the privacy settings you have established at Facebook where you access the application. Facebook allows you to control how you share information with third-party applications, such as Plan X through your privacy settings. Extrafeet does not control what privacy settings Facebook makes available to their users, so we refer you to Facebook’s Privacy Policy to learn what options they make available to their users. Extrafeet does not offer an “opt out” option for specific fields that are shared by Facebook.
If you elect to register using Facebook, you may review, update, correct or delete personal information we receive from Facebook by updating that information on your Facebook profile. If you elect to register with us directly and you would like to review, update, correct or delete that personal information, you may do so by e-mailing us at privacy@extrafeet.com and include:
We will respond to your request within thirty (30) days. Please note that certain records, for example those pertaining to payments or customer service matters, will be retained for legal and accounting purposes. If you have sent or posted content on the Service, we may not be able to delete it.
You can choose to opt out of receiving additional promotional e-mails from Extrafeet by clicking on the “unsubscribe” link in any such e-mail. Please note that once we receive your request, it may take an additional period of time for your opt-out to become effective. Your “unsubscribe” or e-mail preference change will be processed promptly, and in no event longer than 10 business days.
Note that if you opt-out of our Promotional Communications, we may still e-mail or communicate with you from time to time if we need to provide you with information or if we need to request information from you with respect to a transaction initiated by you or for other legitimate non-marketing reasons.
Your information may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Extrafeet transfers Personal Information to the United States and processes it there and your submission of such information represents your agreement to that transfer.
Extrafeet may contain links to other websites that we do not control. We make no representations about and are not responsible for the privacy policies of such other sites nor do we specifically endorse the content of those external websites. We encourage you to read the privacy policies of those external websites to familiarize yourself with how those other websites may collect and make use of your information.
Extrafeet is very concerned with safeguarding your information. Unfortunately, the transmission of information over the Internet is not completely secure. Although we strive to protect your personal data, we cannot guarantee the security of your data while it is being transmitted; any transmission is at your own risk. Once we have received your information, we employ administrative, physical and electronic measures designed to protect your information from unauthorized access.
We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

We do not share personal information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure, typically by “opting in” to receive information from a third party that is participating in a sweepstakes or other promotion. To prevent disclosure of your personal information for use in direct marketing by a third party, do not opt in to such use when you provide personal information.
